Welcome to www.dentistinbedfordview.co.za (the “Website”), operated by Doctor Amod Inc (Registration Number 2017/102082/21), trading as MOD Dentistry | By Dr Zeenat Amod (“MOD Dentistry”, “we”, “us” or “our”). By accessing or using this Website, you agree to comply with and be bound by these Terms.
Doctor Amod Inc (Registration Number 2017/102082/21), trading as MOD Dentistry, is a private dental practice based in Bedfordview, Gauteng, South Africa. This Website is an information and booking-request site: it provides information about our practice and services and allows visitors to request or book appointments. The Website does not offer online payment, e-commerce, or user-account facilities.
2.1 These Terms bind all users in connection with the use of the Website. By accessing, browsing or otherwise using the Website, or by submitting a booking or contact request, you specifically agree to be bound by these Terms.
2.2 If you do not agree with ALL of these Terms, kindly do not use the Website. These Terms are considered an offer by MOD Dentistry, and acceptance is expressly limited to these Terms.
2.3 Any version of these Terms in a language other than English is provided for convenience only, and you agree that the English-language version will control and supersede any other version if there is any conflict.
2.4 Where use of another website or domain has re-routed you to this page, you shall be bound by these Terms.
2.5 These Terms contain provisions which may limit the risk or liability of MOD Dentistry; may create risk or liability for the user; may compel the user to indemnify MOD Dentistry or a third party; and serve as acknowledgement, by the user, of a fact.
2.6 These Terms may apply to users who are consumers for the purposes of the Consumer Protection Act 68 of 2008 (the “CPA”); however, not all users will necessarily be afforded protection in terms of the CPA, subject to the exceptions and exclusions contained therein.
2.7 Nothing in these Terms is intended or must be understood to unlawfully restrict, limit or circumvent any rights and obligations created for either you as the user or MOD Dentistry.
2.8 You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this Website by any third party. You may not use the Website to transmit harmful code, attempt to gain unauthorised access to our systems, or interfere with its operation in any way.

4.1 The Website allows you to request or book appointments online. By submitting a booking request, you confirm that the information you provide is accurate and complete.
4.2 A booking request submitted through the Website is a request only and is not confirmed until you receive confirmation from us. We reserve the right to decline, reschedule or cancel appointments where necessary.
4.3 You are responsible for arriving on time for confirmed appointments and for following any instructions provided by us. Cancellation or rescheduling must be done in accordance with our practice policy, which will be communicated to you on confirmation of your booking.
4.4 Notwithstanding clause 4.2 above, MOD Dentistry will not be bound to any contract or legally binding arrangement arising from the use of the Website, or from communications between it and you, or from anything on its Website.
4.5 MOD Dentistry reserves the right to insist upon written contracts or agreements, as and when deemed appropriate and necessary, within its sole and absolute discretion.
4.6 As such, any information contained on the Website cannot be regarded by you as an offer capable of acceptance that results in a legally binding contract, agreement or arrangement.
Any personal information you submit through the Website (including through the booking system) will be processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy. By using the Website, you consent to the collection and processing of your personal information for the purposes of providing dental services and managing your appointments.
We treat all patient health information as confidential and handle it in accordance with applicable South African health and privacy laws.
6.1 All content on this Website, including but not limited to text, graphics, logos, images and the overall design, is and shall remain the property of MOD Dentistry or its licensors, and is protected by South African and international copyright laws. You may not, under any circumstances, use, copy, reproduce, republish, distribute or modify any content from the Website without our prior written consent, except where otherwise agreed or contemplated in these Terms.
6.2 Users are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Website in accordance with these Terms and for its intended purpose, as set out in clause 4 above.
7.1 The Website may contain links to third-party websites. These links are provided for convenience only. We do not necessarily agree with, edit, sponsor, control, endorse or accept responsibility for the content, availability or practices of any third-party websites, and your use of them is at your own risk.
7.2 MOD Dentistry will not be liable under any circumstances for the content of such other webpages or for any damages or loss suffered as a result of the use thereof.
8.1 To the fullest extent permitted by law, MOD Dentistry, Dr Zeenat Amod, and any of our employees, contractors, agents or service providers will not be liable for any direct, indirect, incidental, consequential or special loss or damage arising out of or in connection with, but not limited to:
8.2 Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under South African law, including liability for fraud, or for death or personal injury caused by our negligence, gross negligence or wilful misconduct.
8.3 You hereby indemnify and hold MOD Dentistry harmless against any claims, losses, damages or costs arising from you or any third party, arising in any way from your use of the Website, save to the extent that such claims arise from the gross negligence or wilful misconduct of MOD Dentistry, its employees, agents or authorised representatives.
8.4 You hereby indemnify MOD Dentistry, its directors, employees and affiliates against any and all loss, claim or damage arising from your violation of, or non-compliance with, any of these Terms.
9.1 By using the Website, you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under 18, or not legally permitted to enter into a binding agreement, you may use the Website only with the guidance and supervision of your parent or legal guardian, who agrees to be bound by these Terms and to be responsible for you and all your obligations under them.
9.2 You warrant that all personal information you provide is accurate and up to date.
9.3 You agree that you will not use the Website for unlawful, abusive or disruptive purposes, or for any other purpose not intended by MOD Dentistry.
9.4 You agree not to engage in any activity that could damage, disable, impair or interfere with the Website. Any person who delivers or attempts to deliver damaging code, or who attempts to gain unauthorised access to the Website, shall be prosecuted, and civil damages shall be claimed for any loss suffered.

10.1 MOD Dentistry may unilaterally amend these Terms at any time without prior notice. It is the user’s responsibility to regularly acquaint themselves with these Terms. Should you not be satisfied, kindly cease and discontinue your use of the Website.
10.2 Any amendment or change will apply once it is displayed on the Website. If you use the Website after such a change has been displayed, you will be deemed to have accepted it.
10.3 Unless notices or alternative processes are required in terms of any applicable law, MOD Dentistry reserves the right to amend, change or supplement these Terms from time to time without prior notice.
11.1 These Terms, and our relationship and any dispute arising from or in connection with them, shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
11.2 Your use of the Website constitutes your consent and submission to the jurisdiction of the South African courts in respect of all proceedings arising from these Terms.
11.3 In the event of any dispute, you consent to the jurisdiction of the High Court of the Republic of South Africa, notwithstanding that the quantum may otherwise fall below the monetary jurisdiction of that court.
11.4 Nothing in this clause or these Terms limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA (where applicable).
12.1 The use of the Website is entirely at your own risk, and you assume full responsibility for any risk or loss resulting from your use of the Website or reliance on any information on it.
12.2 Whilst MOD Dentistry takes reasonable measures to ensure the content is accurate and complete, it makes no representations or warranties as to the quality, timeliness, operation, integrity, availability or functionality of the Website, or the accuracy, completeness or reliability of any information on it.
12.3 MOD Dentistry will not be held liable for any damage, loss or expense, whether direct, indirect or consequential, arising out of or in connection with your access to or use of the Website, unless otherwise provided by law.
12.4 MOD Dentistry makes no warranty or representation that the information or files available on the Website are free of viruses, spyware, malware or any other harmful code.
12.5 As the user, you accept all risk associated with such harmful code, save where such risk arises due to the gross negligence or wilful misconduct of MOD Dentistry, its employees, agents or authorised representatives.
12.6 Any unauthorised access to the Website is strictly prohibited under the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).
12.7 This Website is provided on an “as is” and “as available” basis.

12.9 You may not cede, assign or transfer your rights and obligations under these Terms without our prior written consent.
12.10 The Privacy Policy and the PAIA Manual are an integral part of these Terms and form part of the entire agreement between the parties.
12.11 Any failure by MOD Dentistry to enforce any right shall not constitute a waiver of such right.
12.12 If any term is declared invalid for any reason, the remaining terms will remain in full force and effect.
12.13 These Terms contain the whole agreement between you and MOD Dentistry, and no other warranty or undertaking is valid unless contained in this document or specifically included by reference.
