1. Introduction

Doctor Amod Inc (Registration Number 2017/102082/21), trading as MOD Dentistry | By Dr Zeenat Amod, is a private dental practice based in Bedfordview, Gauteng, providing general and cosmetic dental services to the public. This manual has been prepared in accordance with Section 51 of the Promotion of Access to Information Act, No. 2 of 2000, and is intended to assist any person who wishes to request access to records held by Doctor Amod Inc.

3. Information and Guidelines in Terms of the Act

The Act grants a requester access to records of a private body if the record is required for the exercise or protection of any rights. If a public body lodges a request, it must be acting in the public interest. Requests must be made in accordance with the prescribed procedures and at the prescribed rates (sections 53 and 54 of the Act). Requesters are referred to the Guide compiled by the Information Regulator in terms of Section 10 of the Act.

Patient health information constitutes special personal information under POPIA and is subject to additional confidentiality protections under the Health Professions Act and HPCSA ethical rules.

6. Form of Request for Information

A requester is not automatically entitled to the records requested. Each request will be evaluated on its own merits and in accordance with the Act. To make a request, a requester must:

  • use the prescribed form (Form 02, available on the Information Regulator’s website at https://inforegulator.org.za);
  • address the request to the Information Officer of Doctor Amod Inc at the contact details in Section 2;
  • provide sufficient detail to identify the records requested and the form of access required;
  • provide a postal address, email address or fax number within the Republic of South Africa;
  • identify the right being exercised or protected, and explain why the record is required to exercise or protect that right; and
  • pay the prescribed request fee (where applicable — see Section 7).

Doctor Amod Inc will respond to the request within the time frames prescribed by the Act.

7. Prescribed Fees

Where information is requested (other than personal requests by the data subject): a request fee is payable before the request is processed; a deposit may be required if preparation exceeds the prescribed hours; a requester may lodge a court application against the fee or deposit; and records may be withheld until the prescribed fees have been paid. The current fee structure is published on the Information Regulator’s website at https://inforegulator.org.za.

8. Grounds for Refusal of Access

Doctor Amod Inc may refuse a request on the grounds set out in the Act, including (but not limited to):

  • protection of the privacy of a third party who is a natural person;
  • protection of commercial information of a third party;
  • protection of confidential information;
  • protection of the safety of individuals or property;
  • protection of records privileged from production in legal proceedings;
  • protection of the commercial activities of Doctor Amod Inc; and
  • protection of research information.

In particular, patient health information will not be disclosed except in accordance with the National Health Act, POPIA, the Health Professions Act, and HPCSA ethical rules.

9. Availability of Manual

This manual is available on the Doctor Amod Inc website at www.dentistinbedfordview.co.za; at the principal place of business for inspection during ordinary business hours; and on request, by contacting the Information Officer at the details in Section 2. A copy has been submitted to the Information Regulator as required by the Act.
